Rare Drips, LLC - Spectate Live

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of Spectate Live, a mobile application and related services operated by Rare Drips, LLC ("Rare Drips," "we," "us," or "our").

By accessing or using Spectate Live, you agree to be bound by these Terms. If you do not agree, you may not access or use the service.

2. Eligibility and Age Requirements

Spectate Live is intended only for users aged 18 and older.

By using Spectate Live, you represent that:

• You are at least 18 years old.
• If you are under 18, you have permission from a parent or legal guardian to use the service.
• You have the legal capacity to enter into this agreement.

We do not knowingly allow users under the age of 18. Accounts found to violate this requirement may be suspended or terminated.

3. Nature of the Service

Spectate Live is a platform that enables live, real-time, one-way streaming sessions initiated by viewers, allowing one user ("Host") to stream audio and video content from a personally-owned device to another user ("Viewer").

You understand and agree that:

• Sessions involve live audio and video streamed in real time.
• Streaming is one-way; the Host streams content to the Viewer.
• Sessions may involve interaction with users you do not know.
• Rare Drips does not control, monitor, or guarantee the conduct of any user during live sessions.
• Users are responsible for ensuring their live activity complies with all applicable laws, venue policies, and third-party rights.
• Content and behavior during sessions are the sole responsibility of the users involved.

4. User Accounts and Responsibility

You are responsible for:

• Maintaining the security of your account.
• All activity that occurs under your account.
• Using Spectate Live in a lawful and respectful manner.

You agree not to:

• Impersonate another person.
• Use another user's account without permission.
• Circumvent safeguards or moderation systems.

5. User Conduct

You agree not to engage in behavior that includes, but is not limited to:

• Harassment, threats, or intimidation
• Sexual exploitation or inappropriate conduct
• Hate speech or discriminatory behavior
• Illegal activity
• Attempting to exploit, manipulate, or deceive other users
• Misuse of reporting or flagging features

Violation of these rules may result in moderation action.

6. Reporting, Flags, and Moderation

Spectate Live provides tools for users to report or flag live streaming sessions for safety or policy concerns.

Because sessions involve live, real-time, one-way streaming, Rare Drips relies on user reports and pattern-based review to help identify potential issues.

Important clarifications:

• A flag is not proof of wrongdoing.
• Flags are used as signals, including when evaluated in aggregate.
• Moderation decisions consider context, patterns, and available information.

Rare Drips is not obligated to take action on any specific report.

7. Pattern-Based Safety Review

To promote fairness and safety:

• Single reports generally do not result in punitive action.
• We may review patterns of reports over time, particularly when reports come from multiple different users.
• Being under review does not mean a user has violated these Terms.

Our moderation approach emphasizes investigation and proportional response rather than automatic punishment.

8. Limited Content Capture for Safety Purposes

To maintain platform safety during live, real-time, one-way streaming sessions, Rare Drips may, under limited and justified circumstances, capture restricted session content (such as a single screenshot) solely for moderation and safety review.

Key points:

• Content capture is not continuous recording.
• Capture may occur only in connection with a user-initiated report and when safety review is warranted.
• Captured content is limited in scope, reviewed only by authorized personnel, and retained only as long as necessary for safety, compliance, or legal purposes.
• Captured content is never shared publicly.

By using Spectate Live, you acknowledge and consent to this limited safety practice.

9. Enforcement and Discretion

Rare Drips reserves the right to:

• Investigate potential violations
• Take appropriate action based on available information
• Limit or revoke access to the service

We may act or choose not to act at our discretion. Failure to enforce any provision does not constitute a waiver of our rights.

10. Data Retention and Privacy

We collect and process information in accordance with our Privacy Policy.

Safety-related data (such as reports or moderation records):

• Is used only for trust and safety purposes
• Is not sold or used for advertising
• May be retained for a limited period as required for review, compliance, or legal obligations

11. Disclaimers

Spectate Live is provided "as is" and "as available."

Rare Drips makes no warranties regarding:

• User behavior
• Session outcomes
• Availability or reliability of the service

Use of the service is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Rare Drips, LLC shall not be liable for:

• User conduct
• Content exchanged during sessions
• Indirect, incidental, or consequential damages

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason consistent with platform safety.

You may stop using Spectate Live at any time.

14. In-App Purchases and Refunds

Spectate Live may offer optional in-app purchases, including time-limited no-ads viewing passes and similar digital access features. These purchases are digital goods that are delivered immediately when activated.

Because access is provided immediately, purchases are generally non-refundable once granted or used.

All purchases made through Google Play are also subject to Google Play billing, cancellation, and refund policies. Spectate Live does not control Google Play's final refund decisions and cannot guarantee that a refund will be issued.

If a refund, revocation, chargeback, or other payment reversal is issued by Google Play or the payment provider, Spectate Live may revoke, shorten, or remove the related digital entitlement or access.

Current one-time products may include short-duration no-ads passes such as 3-hour and 12-hour viewing passes. Product names, durations, pricing, and availability may change at any time.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
